Welcome to Uplift Lance. These Terms and Conditions govern your use of our website and the services provided by Uplift Lance. By accessing our website, requesting our services, or engaging us for a project, you agree to these Terms and Conditions.

Please read these terms carefully before using our website or purchasing our services.

1. About Uplift Lance

Uplift Lance provides digital and technology services to individuals, businesses, startups, and organizations worldwide. Our services may include:

  • Website Development
  • Software Development
  • Mobile App Development
  • Graphic Design
  • Digital Marketing
  • Video and Animation
  • Artificial Intelligence Solutions
  • UI/UX Design
  • Website Maintenance and Support
  • Other customized digital services

The specific services, deliverables, timelines, and pricing for each project will be agreed upon between Uplift Lance and the client before work begins.

2. Acceptance of Terms

By accessing or using our website or engaging Uplift Lance for any service, you confirm that you have read, understood, and agreed to these Terms and Conditions.

If you do not agree with any part of these terms, please do not use our website or services.

3. Project Scope

Before starting a project, Uplift Lance may provide a project scope, quotation, proposal, order details, or other written agreement describing the services and deliverables.

The project scope may include:

  • Services to be provided
  • Project requirements
  • Deliverables
  • Estimated timeline
  • Project cost
  • Number of revisions
  • Client responsibilities
  • Payment terms
  • Additional requirements or limitations

Any work requested outside the agreed project scope may require additional charges and/or additional time.

4. Client Responsibilities

Clients are responsible for providing accurate and complete information, materials, and instructions required to complete their project.

Depending on the project, this may include:

  • Text and written content
  • Images and graphics
  • Logos and brand assets
  • Videos and audio files
  • Product information
  • Website or hosting access
  • Social media or advertising account access
  • Scripts and concepts
  • Technical requirements
  • Other necessary project materials

Delays in providing required information, approvals, content, or access may affect the project timeline.

Uplift Lance is not responsible for delays caused by missing, incomplete, inaccurate, or late client-provided materials.

5. Payments

Project pricing and payment terms will be communicated to the client before work begins.

Unless otherwise agreed in writing:

  • Work may begin after the required payment or deposit has been received.
  • Additional work outside the agreed scope may be charged separately.
  • Third-party costs may not be included in the quoted service price.
  • Clients are responsible for providing accurate billing and payment information.

Third-party costs may include hosting, domains, premium plugins, software subscriptions, stock assets, API usage, advertising costs, licenses, or other external services.

6. Revisions and Changes

The number of revisions included in a project will depend on the agreed project scope.

A revision generally means reasonable modifications to the agreed deliverable.

Requests that substantially change the original concept, functionality, design, script, structure, or project requirements may be considered additional work and may result in additional charges and an updated timeline.

Clients should provide clear and consolidated feedback whenever possible to help avoid unnecessary delays.

7. Project Timelines

Uplift Lance will make reasonable efforts to complete projects within the agreed or estimated timeframe.

However, timelines may be affected by:

  • Delayed client feedback
  • Missing content or materials
  • Changes to project requirements
  • Technical issues
  • Third-party services
  • Hosting or server problems
  • Platform restrictions
  • Other circumstances outside our reasonable control

Any stated delivery date should therefore be considered an estimated timeframe unless a specific deadline has been expressly agreed upon in writing.

8. Website and Software Services

For website and software development projects, the final functionality will be based on the agreed project scope and technical requirements.

Uplift Lance is not responsible for problems caused by:

  • Third-party plugins or software
  • Hosting providers
  • Server configuration
  • Client modifications
  • Unauthorized changes to the website or software
  • Third-party APIs
  • External service interruptions
  • Unsupported software or outdated systems

Clients are responsible for maintaining appropriate backups unless ongoing backup and maintenance services have been specifically included in the project.

9. Third-Party Services and Platforms

Some projects may require the use of third-party services, platforms, software, APIs, plugins, hosting providers, payment processors, advertising platforms, or other external tools.

Uplift Lance does not control third-party services and cannot guarantee their continuous availability, pricing, policies, functionality, or performance.

Any third-party service fees are generally the responsibility of the client unless otherwise agreed.

10. AI-Generated Content and Technology

Some Uplift Lance services may use artificial intelligence technologies as part of the creative or development process.

Depending on the project, AI-assisted tools may be used for content generation, image creation, video production, animation, voice generation, coding assistance, data processing, or other purposes.

AI-generated results may occasionally contain inaccuracies, inconsistencies, artifacts, or other unexpected results. Uplift Lance will make reasonable efforts to review and improve deliverables, but cannot guarantee that AI-generated content will always be completely error-free or identical to a specific reference.

Clients are responsible for reviewing and approving final deliverables before public use.

11. Intellectual Property

Unless otherwise agreed in writing, ownership and usage rights for final project deliverables will be determined by the applicable project agreement and payment terms.

Client-provided materials remain the property of the client or their respective owners.

Uplift Lance retains ownership of its pre-existing:

  • Code
  • Frameworks
  • Templates
  • Processes
  • Methods
  • Tools
  • Design systems
  • Reusable components
  • Internal resources

Unless expressly transferred in writing, payment for a project does not automatically transfer ownership of Uplift Lance’s pre-existing tools, systems, or reusable resources.

12. Client-Provided Content

The client represents that they have the necessary rights, permissions, licenses, or authorization to provide any content, materials, images, music, videos, logos, trademarks, text, data, or other assets supplied to Uplift Lance.

The client is responsible for ensuring that their materials do not infringe the rights of any third party.

Uplift Lance is not responsible for claims arising from unauthorized materials supplied by the client.

13. Portfolio and Promotional Use

Unless the client requests confidentiality or otherwise agrees with Uplift Lance in writing, Uplift Lance may display completed work in its portfolio, website, social media, presentations, proposals, or marketing materials to demonstrate its services.

If a project contains confidential or sensitive information, the client may contact Uplift Lance to discuss confidentiality restrictions.

14. Confidentiality

Uplift Lance will take reasonable measures to protect confidential project information provided by clients.

Confidential information may include business information, credentials, strategies, technical information, documents, and other information that is reasonably understood to be confidential.

Information that is publicly available, independently developed, already lawfully known, or required to be disclosed by law may not be considered confidential.

15. Communication and Approvals

Clients are responsible for reviewing project updates, drafts, and deliverables and providing timely feedback or approval.

Once a deliverable has been approved by the client, additional changes may be treated as new work and may incur additional charges.

Uplift Lance may use email, messaging platforms, project management tools, or other agreed communication channels for project-related communication.

16. Cancellation and Termination

Either party may request to cancel a project, subject to the terms of the applicable project agreement.

If a client cancels a project after work has started, the client may be responsible for payment for work already completed, non-refundable third-party expenses, and other approved project costs.

Uplift Lance may suspend or terminate services if the client:

  • Fails to make required payments
  • Provides unlawful or infringing materials
  • Repeatedly changes the agreed scope without approval
  • Engages in abusive or inappropriate conduct
  • Violates these Terms and Conditions
17. Refunds

Refund eligibility will depend on the nature of the service, project status, work already completed, and the applicable agreement or quotation.

Because many Uplift Lance services involve customized work, development time, creative production, or third-party expenses, completed work and certain project costs may not be refundable.

Any applicable refund terms will be communicated to the client where relevant.
